Acceptance of Terms
These Terms of Service govern your access to and use of NeverMissCalls.ca and any related services, tools, features, call flows, messaging functions, or communication systems provided by NeverMissCalls (“NeverMissCalls,” “we,” “our,” or “us”).
By accessing, subscribing to, or using the service, you agree to be bound by these Terms. If you do not agree, you should not use the service.
Service Overview
NeverMissCalls provides a receptionist and communications support system designed to help businesses respond to inbound opportunities across channels such as voice, SMS, web chat, and related workflows.
Depending on your setup, the service may answer calls, collect caller information, route conversations, provide basic scripted responses, send follow-up messages, summarize interactions, or help surface lead and intake information to your business.
NeverMissCalls is a communications tool and service platform. It is not a law firm, emergency dispatch provider, financial advisor, medical provider, insurer, or other licensed professional service unless expressly stated in writing.
Eligibility & Account Use
You represent that you have the authority to enter into these Terms on behalf of yourself or the business you represent. You are responsible for maintaining accurate account, billing, and business information at all times.
You agree not to use the service for unlawful, fraudulent, abusive, misleading, or prohibited activities, including communications that violate applicable privacy, telemarketing, consumer protection, or recording laws.
Automated & AI-Assisted Interactions
The service may use automated systems, logic-based workflows, transcription tools, synthesized speech, or AI-assisted processes to help generate responses, summarize conversations, collect information, or move an interaction forward.
You acknowledge that such systems may occasionally produce incomplete, inaccurate, delayed, or imperfect outputs. NeverMissCalls does not guarantee that every interaction, transcript, response, classification, summary, or routing decision will be error-free.
Unless explicitly agreed otherwise in writing, the service should not be relied on as the sole decision-maker for legal, medical, emergency, financial, or other high-stakes matters.
Call Recording & Compliance
Calls, messages, chats, transcripts, recordings, and related interaction data may be recorded, stored, transcribed, monitored, analyzed, or summarized for service delivery, quality assurance, troubleshooting, training, analytics, product improvement, and account support.
You are solely responsible for determining whether your business must provide notice, obtain consent, or meet other legal requirements before recording or monitoring a communication. This includes compliance with federal, provincial, territorial, and local laws that may apply to your business or your customers.
NeverMissCalls does not provide legal advice, and your use of the service does not shift your compliance responsibilities to us.
Client Responsibilities
You remain fully responsible for your business operations and for how you use the information captured through the service.
- Maintaining accurate scripts, service details, contact information, and operational rules.
- Following up with leads, customers, and inquiries in a lawful and commercially appropriate way.
- Reviewing captured information before acting on it where verification matters.
- Ensuring your internal workflows, staff actions, and service promises remain accurate.
- Using the service in a way that complies with applicable privacy, advertising, consumer, and communications laws.
If your business operates in a regulated or high-risk industry, you are responsible for determining whether the service is appropriate for your intended use.
Billing, Renewals & Payment
Paid services are billed on a recurring subscription basis unless otherwise stated in writing. By subscribing, you authorize NeverMissCalls and its payment processors, including Stripe where applicable, to charge the payment method on file for recurring fees, applicable taxes, usage-based charges, setup fees, and any approved add-ons.
Subscription terms, billing frequency, and pricing may be presented during checkout, in a service proposal, or in your client agreement. Unless otherwise stated, subscriptions renew automatically until cancelled.
Except where required by law or expressly stated otherwise in writing, fees are non-refundable. You are responsible for keeping payment information current and valid.
Cancellations & Suspension
You may cancel your subscription in accordance with the cancellation terms that apply to your plan or written agreement. Cancellation will generally stop future renewals but will not retroactively reverse charges already incurred.
We may suspend, restrict, or terminate access to the service if payment fails, if your use creates legal or operational risk, if you breach these Terms, or if continued service is not commercially reasonable.
Suspension or termination does not waive your obligation to pay outstanding amounts owed.
No Performance Guarantees
NeverMissCalls is designed to improve responsiveness and help your business reduce lead leakage, but we do not guarantee any specific commercial outcome.
- No guarantee of revenue, profit, or return on investment.
- No guarantee of lead conversion or booking volume.
- No guarantee of customer retention or closing rates.
- No guarantee that every caller, message, or opportunity will be captured perfectly.
Business performance depends on many variables outside our control, including your offer, pricing, sales process, staff response time, market conditions, and follow-up execution.
Intellectual Property
Unless otherwise stated in writing, NeverMissCalls and its licensors retain all rights, title, and interest in the service, software, workflows, templates, scripts, site content, branding, designs, documentation, and related materials.
Subject to your compliance with these Terms and payment obligations, we grant you a limited, non-exclusive, non-transferable, revocable right to use the service for your internal business use.
You may not copy, resell, reverse engineer, republish, distribute, or create derivative works from the service or related materials except as expressly permitted in writing.
Confidentiality & Data Handling
We will use commercially reasonable efforts to protect information submitted to the service, but no platform, transmission method, or storage system can be guaranteed to be completely secure.
You acknowledge that service data may be processed through hosted infrastructure, third-party tools, integrations, analytics systems, communications providers, and payment processors as reasonably required to operate the service.

Third-Party Services
The service may depend on or integrate with third-party providers, including telephone services, hosting providers, CRM systems, payment processors, email systems, analytics platforms, and other external tools.
We are not responsible for outages, errors, delays, interruptions, pricing changes, policy changes, or security events caused by third-party services outside our reasonable control.
Disclaimers
To the maximum extent permitted by law, the service is provided on an “as is” and “as available” basis. NeverMissCalls disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
We do not warrant that the service will be uninterrupted, error-free, fully secure, or suitable for every business model, industry, or compliance environment.
Limitation of Liability
To the fullest extent permitted by law, NeverMissCalls and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of revenue, profits, business, goodwill, data, customers, opportunities, or expected savings arising out of or related to your use of the service.
This limitation applies whether the claim is based in contract, tort, negligence, strict liability, statute, or any other legal theory, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for any claim arising from or relating to the service will not exceed the amount you paid to NeverMissCalls for the service during the three-month period immediately preceding the event giving rise to the claim.
Indemnity
You agree to defend, indemnify, and hold harmless NeverMissCalls and its affiliates, officers, contractors, and service providers from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from or related to:
- Your use of the service.
- Your breach of these Terms.
- Your business practices, offers, representations, or follow-up actions.
- Your failure to comply with recording, privacy, consumer protection, or communications laws.
- Any content, scripts, business information, or instructions you provide to the service.
Changes to Service or Terms
We may modify, improve, suspend, replace, or discontinue any aspect of the service at any time. We may also update these Terms from time to time.
When we update these Terms, we may revise the “Last Updated” date above. Your continued use of the service after changes become effective constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of laws principles.
Although NeverMissCalls may serve businesses across Canada, these Terms will still be interpreted and governed under Ontario law unless otherwise required by applicable law.
