You must be at least 18 years old and legally capable of entering into a binding agreement to use our Services.


3. Account & User Responsibilities

You agree to:

Provide accurate and complete information

Maintain the confidentiality of your account

Be responsible for all activity under your account

Use the Services in compliance with all applicable laws

You are solely responsible for how you use our Services, including communications sent to your customers.


4. Compliance with Communication Laws (IMPORTANT)

You agree to comply with all applicable laws related to communications, including but not limited to:

Canada’s Anti-Spam Legislation (CASL)

Any applicable call recording and consent laws

Privacy and data protection laws

You are responsible for obtaining proper consent from your customers before sending SMS messages or recording calls where required.


5. Call Recording, Transcripts & AI Processing

By using our Services, you acknowledge and agree that:

Calls may be recorded

AI-generated transcripts and summaries may be created

Data may be processed for service delivery, analytics, and improvement

You are responsible for informing your customers of call recording where required by law.


6. SMS & Communications Consent

By submitting your information or interacting with our Services, you consent to receive communications from us, including:

Calls

Emails

SMS messages

Message frequency may vary. Message and data rates may apply. You may opt out at any time by replying STOP.


7. Payments, Billing & Subscriptions

Services may include one-time setup fees and recurring subscription fees

Payments are processed through third-party providers (e.g., Stripe)

You authorize recurring billing where applicable

Failure to pay may result in service suspension or termination


8. Cancellation & Refunds

You may cancel your subscription at any time

Cancellation prevents future billing but does not refund past charges

All fees are non-refundable unless otherwise stated


9. Service Availability

We do not guarantee uninterrupted, error-free, or continuous operation of the Services.

We are not responsible for:

Missed calls

Delayed or failed messages

System outages

Third-party service failures (e.g., telecom providers, hosting platforms)


10. No Guarantee of Results

We do not guarantee any specific business outcomes, including:

Increased revenue

Lead generation

Conversion rates

Use of the Services is at your own risk.


11. Intellectual Property

All content, software, and technology associated with the Services are owned by NeverMissCalls.ca or its licensors.

You are granted a limited, non-exclusive, non-transferable license to use the Services.
